Terms of sale
General provisions
* These Kundalini Kakao e-shop (hereinafter referred to as the e-shop) terms and conditions of sale (hereinafter referred to as the terms) apply to purchases from the internet address www.kundalinikakao.ee. The seller of the goods is Kundalini Shakti OÜ (hereinafter referred to as the seller), address Luisu 7-1, Tallinn, registry code 16763912, e-mail address kundalinikakao@gmail.com. The terms and conditions apply to the legal relationships arising between all persons (hereinafter referred to as the customer) and the seller when purchasing goods through africantusker.com.
* The seller has the right to unilaterally amend and supplement the terms and conditions by publishing new terms and conditions on the internet address www.kundalinikakao.ee. If the customer submitted an order before the changes to the terms and conditions entered into force, the terms and conditions in force at the time of submission of the order shall apply to the legal relationship between the customer and the seller.
* The customer can save, print and, if necessary, reproduce the terms and conditions before making a purchase, and the customer agrees to the provisions of the terms and conditions when making a purchase from the e-shop.
* In addition to the terms and conditions, the legal acts valid in the Republic of Estonia apply to purchases made from the e-shop.
PLACEMENT OF AN ORDER
* Orders can be placed on the e-shop page, either by logging in as a customer or as a guest.
* The customer selects the desired goods from the e-shop and adds them to the shopping cart.
* The customer selects the place of delivery of the order. We deliver the goods to Estonian parcel lockers.
* The customer confirms the shopping cart and pays for the goods in the payment environment provided by the seller. Before paying the invoice, the customer checks that the data provided in the invoice corresponds to the customer’s actual wishes.
* The seller sends the customer a confirmation and invoice by e-mail regarding the receipt of the order and payment.
* The sales contract between the seller and the customer enters into force upon receipt of the purchase amount paid by the customer in full to the seller’s bank account.
* If the ordered goods cannot be delivered due to the end of the goods or for another reason, the customer will be notified as soon as possible and the money paid (including the costs of delivering the goods) will generally be refunded within 1-2 working days. Depending on the payment method, receipt may take up to 7 working days.
PRICE OF THE GOODS, PAYMENT OPTIONS
* All prices of goods sold on the kundalinikakao.ee website are shown in euros and are VAT-free.
* The customer pays the full sales price and delivery fee for the order as an advance payment. Payment is made in the online store in the payment environment selected by the Seller. The Seller does not have access to the customer’s credit card details.
RECEIVING THE GOODS
* We ship the goods to Smartpost parcel machines in Estonia. In the case of a one-time order, a delivery fee of €2.99 will be added to the delivery of the goods to the Estonian Smartpost parcel machine selected by the customer.
* Shipments within Estonia generally reach the destination specified by the customer within 3-7 working days from the entry into force of the sales contract.
* In exceptional and justified cases, the right to deliver the goods is up to 30 working days.
* On Saturdays, Sundays and public holidays, the delivery/assembly of goods does not take place.
* The customer is notified of the arrival of the goods at the parcel terminal by an SMS message, which contains a unique door code to open the parcel terminal door.
* The seller is not liable for any damage caused to the customer if, for reasons not attributable to the seller, third parties have obtained the parcel terminal’s unique code and the goods have been received on the basis of this code.
* Upon receipt of the goods, the customer undertakes to open the product packaging carefully, without damaging the packaging and products. If the customer has damaged the packaging due to negligence, although the product packaging could have been opened without damaging it, the seller has the right to demand compensation for the damage caused when returning the goods.
* If the customer discovers upon receipt of the goods that they have been sent the wrong or defective goods, they must immediately notify the seller’s customer service by e-mail at kundalinikakao@gmail.com
PROCESSING OF CUSTOMER PERSONAL DATA
* The seller has the right to process the personal data and purchase data provided by the customer in accordance with applicable legislation to the extent necessary, in particular, to fulfill the order placed by the customer in the online store.
* The seller takes all measures (including administrative, technical and physical measures) to protect the customer’s personal data. Access to change and process data is only available to authorized persons.
EXCHANGE OF GOODS
* The customer has the right to exchange the goods within 14 days of receipt, either for a different size or for another product available in the online store www.kundalinikakao.ee, if the packaging is unopened and unchanged.
* To exchange the goods, the customer must express the request for exchange by e-mail to kundalinikakao@gmail.com
* When exercising the right to exchange, the customer is obliged to return the goods to the seller no later than 14 days after submitting the exchange application.
* Direct costs related to the exchange are borne by the customer.
* The exchanged goods must be sent to the parcel machine on the 1st floor of Kriistine Center (Smartpost) (Harju County), tel. no. +37256728448, recipient Kundalini Kakao.
RETURN OF GOODS, WITHDRAWAL FROM THE CONTRACT AND REFUNDS
* The customer has the right to withdraw from the contract without giving a reason within 14 calendar days from the receipt of the goods.
* To return the goods, the customer must express the request by e-mail to kundalinikakao@gmail.com
* When exercising the right of withdrawal, the customer is obliged to return the goods to the seller no later than 14 days after submitting the withdrawal application.
* Direct costs related to the return are borne by the customer.
* The returned goods must be sent to the Kriistine Centre 1st floor (Smartpost) parcel machine (Harju County), tel. no. +37256728448, recipient Kundalini Kakao.
* If the customer wishes to avoid compensation for the decrease in value, the item must be used and tried on as it is possible to do in a regular store and the item must be returned in its original packaging and original completeness. If the consumer uses the item more than is necessary to verify the nature and functioning of the item or does not return the item in its original packaging and original completeness or uses the item in another inappropriate way, the consumer is responsible for the decrease in value of the item.
* If the customer has withdrawn from the transaction, the seller will refund the payments made for the order immediately, but no later than within 21 calendar days of the withdrawal application and the goods reaching the seller. The refund will be made to the bank account that the customer sends together with the withdrawal application by e-mail.
* If the customer has damaged or damaged the returned goods intentionally or through negligence, the seller has the right to refuse to take back the goods or demand compensation for the damage caused.
SUBMISSION OF CLAIMS AND LIABILITY
* The seller is liable for any non-conformity of the purchased goods within 2 years from the date of delivery of the goods to the customer. In the case of selling goods to a consumer, it is assumed that the non-conformity with the terms of the contract that has become apparent within 1 year from the date of delivery of the goods to the customer existed at the time of delivery of the goods, unless such an assumption is contrary to the nature of the goods or the defect. The customer undertakes to notify the seller of the non-conformity of the goods no later than 2 months from its discovery, i.e. to submit a claim.
* The seller is not liable for defects that have arisen after the goods have been handed over due to the consumer’s actions or inaction (incorrect use, accident, etc.) or if it is normal wear and tear due to normal use of the item.
If the purchased goods have defects for which the seller is responsible, the seller will repair or replace the defective goods. If the goods cannot be repaired or replaced, the seller will refund all fees incurred under the sales contract to the buyer.
* The customer must submit a claim by e-mail to kundalinikakao@gmail.com. The claim must state the customer’s name and contact details, the date of submission of the claim, the defect in the goods and the content of the claim, and attach a document proving the purchase.
* The seller is not liable for damage resulting from incorrect data provided by the customer when fulfilling the order or any other consequences, including a delay in delivery if this is due to circumstances beyond the seller’s control.
* The seller is not liable for damage resulting from the improper use of the ordered goods.
* Disputes arising between the seller and the customer shall be resolved by the parties through negotiations.
* If the buyer and the seller are unable to resolve the dispute through an agreement, the buyer may turn to the Consumer Disputes Commission. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and the seller. The review of the buyer’s complaint by the Commission is free of charge. The buyer may turn to the European Union’s consumer dispute resolution platform.
